Abstract
The primary objective of this dissertation is to support the proposition that an employee, accused of misconduct, be afforded the same rights as are provided the accused in a criminal investigation. The point is established, on the basis of various National Labor Relations Boards (NLRB) and court decisions, that the duty of fair representation does not cease with the completion of the labor contract negotiations. Collective bargaining should be considered as a continuing process involving day-to-day adjustments in the contract and other working rules. It should also include resolution of new problems not covered by existing agreements and the protection of employee rights already secured by the contract. There should be no more discrimination in administering these functions than in negotiating a labor agreement. ...
