The Rulemaking Process in Texas Agencies
Abstract
This paper examines the processes used to make rules within twelve Texas agencies. Guidelines have been generated by the Administrative Procedure and Texas Register Act to facilitate rulemaking procedures. These general guidelines and the discretion which they allow agencies to employ have a marked affect on efficiency and accountability in Texas agencies. The rule initiation, development, and finalization processes have been examined to determine what characteristics affect the discretion agencies use and then each of the characteristics is discussed in terms of efficiency and accountability.
